Data Processing Agreement

Effective Date: August 1, 2025

This Data Processing Agreement ("DPA") supplements the Terms of Service and applies to the processing of personal data by Hundred Solutions AS (operating the dversi platform) on behalf of the customer.

1. Definitions

  • "Data Controller" refers to the customer determining the purposes and means of the processing of personal data.
  • "Data Processor" refers to Hundred Solutions AS, processing personal data on behalf of the Data Controller.
  • "Data Protection Laws" refers to applicable and binding privacy legislation, including the GDPR (General Data Protection Regulation) and Norwegian data protection laws.

2. Processing of Personal Data

Hundred Solutions AS shall process personal data solely for the provision of the Services as described in the Terms of Service and in accordance with the documented instructions of the Customer.

3. Confidentiality

Hundred Solutions AS shall ensure that personnel authorized to process personal data have committed themselves to confidentiality or are under an appropriate statutory obligation of confidentiality.

4. Security Measures

Hundred Solutions AS implements and maintains appropriate technical and organizational measures to ensure a level of security appropriate to the risk, protecting personal data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access.

5. Sub-processors

The Customer provides general authorization for Hundred Solutions AS to engage sub-processors to process personal data (such as AWS and Anthropic). Hundred Solutions AS shall inform the Customer of any intended changes concerning the addition or replacement of sub-processors.

6. Data Subject Rights

Hundred Solutions AS shall, to the extent legally permitted, promptly notify the Customer if it receives a request from a Data Subject to exercise their rights under Data Protection Laws. Hundred Solutions AS will assist the Customer in fulfilling its obligation to respond to such requests.

7. Data Deletion

Upon termination of the Services, Hundred Solutions AS shall, at the choice of the Customer, delete or return all personal data to the Customer, unless applicable laws require storage of the personal data.
